General terms and conditions for online sales
Art.1 - General provisions
These conditions regulate the online sale of the product distributed by Mo-Food S.r.l., with registered office in Bolzano (BZ), via Dodiciville, 7/D, P.IVA 02892180213, N. REA BZ-214245, hereinafter referred to as "Mo-Food S.r.l." through its official website WWW.N-N.it.
These conditions may be subject to further legal changes, the date indicated below is the effective date on which they were created and published on the website.
The present conditions apply exclusively to purchases made on the official website WWW.N-N.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on electronic commerce.
Art. 2 - Pre-contractual conditions
The customer is informed before the conclusion of the purchase contract by validating the order with "Go to Payment":
- the total price of the goods including taxes, with details of shipping and other costs;
- the method of payment;
- the period within which Mo-Food S.r.l. undertakes to deliver the goods;
- the existence of the legal guarantee of conformity of the purchased goods;
- the conditions and procedures for exercising the right of withdrawal (art. 13 of these Conditions) and the standard withdrawal form in Annex I, Part B of Legislative Decree 21/2014;
- information about the return.

Art. 3 - Subject of the contract
The present general conditions of sale govern the sale by Mo-Food S.r.l. WWW.N-N.it of the product indicated and offered for sale on the official website
By continuing the ordering process on the relevant website, you accept the current general conditions of sale and the privacy rules indicated therein (which can be read in ART. 13 Data Processing), which are applied by Mo-Food S.r.l. as the person responsible for data processing.
The user (hereinafter referred to as the Customer), before accessing the product made available through the Website, is obliged to carefully read the current General Conditions of Sale of Mo-Food S.r.l., which are clearly accepted at the time of purchase.
Art. 4 - The offered products
The product marketed by Mo-Food S.r.l. is described in detail on the website WWW.N-N.it
Before concluding the purchase contract, the Customer can consult the characteristics of the product, which are shown in the dedicated areas of the website before making the choice.
Art. 5 - Conclusion of the contract, effectiveness of the contract and duration of the contract
The contract is concluded exclusively through the Internet, through the client's access through the "I order" button accessible from the website WWW.N-N.it and the realization of an order according to the procedure provided for on the website itself.
The following procedure is foreseen for the purchase:
- order without registration: this is necessary in order to conclude the purchase contract, fill in the form in electronic form and forward it according to the relevant instructions.
Before concluding the contract, the customer reads the general conditions of sale, the image of the product, its price, the means of payment to be used and the related shipping and delivery costs.
The Customer is obliged to pay the price as soon as the online ordering process is completed. This is done by clicking on the "Go to payment" button at the end of the assistant.
Once the agreement has been concluded, Mo-Food S.r.l. will accept the order for its execution.
Mo-Food S.r.l. undertakes to deliver the goods within 7 days from the order.
The offer provides for the execution of activities related to services and/or products that are exhausted at the end of the execution of the same ("One-Shot Services and/or Products").
In the case of "One-Shot Services and/or Products", this Agreement shall expire at the end of the execution of the activities, without prejudice to the obligations regarding the payment of fees by the Customer.
In any case and at any time, the Customer may withdraw from the Contract by giving written notice and by complying with the provisions of article 14 of these Terms of Sale.
Art. 6 - Product Availability
The product availability refers to the actual availability at the time the customer places the order.
In any case, availability must be considered indicative, as the product may be sold to other customers before the order is confirmed, as several users are present on the site at the same time, or a computer anomaly may occur making the purchase of the product available that it is not in fact.
In such cases, the order will be automatically corrected by deleting the product and the customer will be immediately informed by e-mail.
If the Customer requests the cancellation of the order by cancelling the contract, Mo-Food S.r.l. will refund the amounts paid by the Customer.
The Customer will be informed immediately by e-mail about the way and the time of the refund of the amounts paid.
Art. 7 - Payment methods and prices
The price of the product is indicated on the official website WWW.N-N.it below the product.
The selling price of the product is indicated in Euro on the official website WWW.N-N.it and includes VAT.
The shipping costs are displayed and calculated at the end of the purchase process before the payment is completed.
The price may change continuously at any time. However, these changes do not affect orders for which the order confirmation has already been sent, therefore the goods will be invoiced on the basis of the price indicated on the website at the time the order is placed.
Once you have selected the product and clicked on "Order Book", simply follow the purchase instructions, entering or checking the required information at each step of the process. The order details can be changed before payment.
Payment can be made using the payment methods indicated on the website, such as
- bank transfer;
- PayPal payment method.
Art. 8 - Delivery
Mo-Food S.r.l. delivers all over the world.
Mo-Food S.r.l. delivers to the customer's home and the order is delivered within 7 days from the date of purchase.
The shipping costs are at the expense of the customer and are expressly highlighted at the time of the order.
Art. 9 - Legal guarantee of compliance
Mo-Food S.r.l. is responsible for any defect of the product offered on the indicated website, including the non-conformity of the article with the product ordered, according to the provisions of Italian law.
In case of receipt of a faulty product or in any case not in conformity with the orders placed, the Customer has the right to choose between these options:
- free restoration of conformity of the product by replacing the product itself;
- termination of the contract in respect of the disputed goods and the consequent return of the amount of money.
The legal warranty period is two years from delivery of the product; the customer can exercise this right within 2 months from the discovery of the defect.
Art. 10 - Transfer of risk
The risks in connection with the products are transferred to the customer upon receipt of the goods.
Ownership of the Products shall be deemed to have been acquired upon receipt of full payment of all amounts due in connection with the Products, including shipping charges, or at the time of delivery, if later.
Art. 11 - Right of withdrawal
In accordance with the applicable regulations, the customer has the right to withdraw from the contract within 14 days of receipt of the products without giving reasons and without penalty.
If the Customer wishes to exercise his right of withdrawal beyond the fourteenth day, Mo-Food S.r.l. may request the payment of a penalty from the Customer.
In case of multiple purchases made by the Customer with a single order and delivered separately, the 14-day period starts from the date of receipt of the last product.
The User who wishes to exercise his right of withdrawal must immediately notify Mo-Food S.r.l. by means of an express declaration or, alternatively, by sending the standard withdrawal form, in accordance with Annex I, Part B, Legislative Decree 21/2014 not obligatory, included in the e-mail confirming the dispatch of the order.

Art. 12 - Return of goods
In case of return of the goods, the customer is obliged to return the purchased products within 14 days of receipt of the goods.
The goods must be returned to Mo-Food S.r.l.
The goods must be returned intact, in their original packaging, complete with all parts (including documentation and accessories) and the attached tax documents.
The product must be in a normal state of preservation. The customer is only liable for the reduction in value resulting from handling other than "normal" handling, which is necessary to verify the nature, characteristics and functioning of the goods.
Without prejudice to the right to verify compliance with the above provisions, Mo-Food S.r.l. will refund, within a period of 14 days from the date of shipment of the product by the Customer, the amount of the returned goods purchased, excluding shipping costs.
In case of return, the goods will be sent back by a carrier agreed with Mo-Food S.r.l. and in case of purchases within the European Union, the costs of return will be borne by Mo-Food S.r.l.
In case the Customer intends to use the services of other carriers or other means of shipment, all the costs will be at his expense and Mo-Food S.r.l. is released from any responsibility for the return.
For purchases made outside the European Union, with the exception of Switzerland, all costs of returning the purchased product are at the expense of the customer (the costs of returning the product include customs duties, which may vary).
Enter the amount of the costs, if any, and indicate at least orders of magnitude.
The refund will be issued using the same payment method the customer selected during the purchase process, except for the credit card payment method.
Art. 13 - Data processing
The Customer's data will be processed by Mo-Food S.r.l. in accordance with the provisions of the legislation in force on the protection of personal data, as indicated in the information under art. 13 of GDPR 679/2016 below.

- Purpose and legal basis of the processing
Your data are processed in order to execute the contract between you and our structure and to fulfil the obligations arising from the law.
- Persons to whom the data may be communicated
Your data may be transmitted, by way of example and without claiming to be complete, to accounting or tax consultants, banking, credit or insurance institutions, transport companies and/or companies affiliated with us, parent or subsidiary companies in order to provide the agreed service. Only the data strictly necessary for the performance of the service requested will be communicated and, where possible, anonymous processing methods will be preferred.
The communication of this data is compulsory in order to fulfil the agreed contract and any refusal to communicate it will make it impossible for the undersigned to provide the agreed services.
Your data will not be communicated to third parties in any way without your prior and express consent.
- Transfer of data to a third country or international organisations
Under no circumstances will your data be transferred to third countries outside the EU.
A copy of your data can be obtained at the registered office of the owner, who can be contacted via the contact details in point a) of this notice.
- Duration of the storage of personal data
Your personal data will be kept for 1 month in accordance with other civil and tax regulations that may determine further retention periods.
- Rights of the data subject
You have the right to request access to your data and its correction or deletion from the Data Controller at any time. You will receive written feedback within 30 days (unless you expressly request oral feedback), including by electronic means. You also have the right to request the restriction of processing or
to oppose this. Finally, you can request the transferability of your data to another data controller. You can also withdraw your consent at any time by means of this information notification. To revoke one or more of the consents given, it is sufficient to contact one of the addresses given in letter a) of this information notice.
- Right to lodge a complaint with the supervisory authority
If you believe that your data have been processed unlawfully, you have the right to lodge a complaint with the supervisory authority.
- Compulsory or optional nature of data provision and consequences of non-provision
The communication of your data to the data controller is compulsory only for the data necessary to fulfil the purposes referred to in point b) and failure to communicate the data will make it impossible to perform the contract concluded correctly.
- Automated decision-making processes
The owner does not in any way use automated decision-making processes regarding your personal data.
Art. 14 - Applicable law and place of jurisdiction
These general sales conditions are subject to Italian law and shall be interpreted accordingly.
Any dispute that cannot be settled amicably shall be subject to the jurisdiction of the court of the customer's place of residence or domicile, if the customer is located on the territory of the Italian State.
In accordance with the provisions of EU Regulation No. 524/2013, the Seller informs the Buyer that a European platform for the online resolution of consumer disputes (so-called ODR platform) has been established. The ODR platform is available at the following address: http://ec.europa.eu/consumers/odr/. The ODR platform is an access point for buyers who wish to settle disputes arising from online sales or service contracts out of court. For this purpose, the e-mail address of the seller is hereby provided;
For anything not expressly provided for, reference is made to the provisions of the Civil Code and special laws. In case of problems of interpretation of the texts, reference is made to the Italian version!
